The buyer is defined below as being the company or the person signing and accepting these terms and conditions. The terms and conditions of sale apply exclusively to all sales completed by the SAS Avenue des Jeux. Information contained in catalogues, price lists, websites, notes, etc... are only indicative and as such may be changed without notice by the seller. The mere fact of placing an order or accepting an offer from the seller constitutes full acceptance of these terms. These conditions can be modified at any time without notice by the SAS Avenue des Jeux, changes are then applied to all subsequent orders.
For all the orders placed on the website www.the-red-elf.co.uk and any other websites of the SAS Avenue des Jeux, orders are effective from the date of debit from the buyer's account regarding bankcards.
Any sale is subject to availability in stock. Any clause coming from the buyer, not accepted in writing by the seller that would contradict these terms and conditions of sale, or features specified in the offer price will be considered null and void. No unilateral cancellation of orders will be accepted without the agreement of the SAS Avenue des Jeux.

Whatever delivery mode is chosen, the risks associated with transport (loss, damage or theft) are covered by the seller under the condition that the buyer has checked the goods on arrival and has exercised, if appropriate, their claim against the carrier within 48 hours, even when the shipping freight is free. In all cases, delivery is accomplished either by direct delivery to the buyer, either by notice of availability, either by delivering goods to a carrier (Coliposte, Chronopost, DHL, UPS).
Parcels are shipped within 15 business days.
In the case of a loss of parcels during the transport, the time of investigation can vary depending on the carriers and can take one to three weeks.
The seller is authorized to make partial deliveries. If the buyer accepts a partial delivery, the payment must be made upon delivery. By express agreement, the seller shall be automatically discharged from liability in case of force majeure, or in case of events including the following : lock-out, strike, epidemic, war, requisition, fire, flood, machinery breakdown, delay in transport or any other cause resulting in the total or partial interruption of the operations of the seller or their suppliers. The seller shall keep the buyer informed within due time of the cases and events listed above. Delivery can only be made on time if the buyer has met with all their obligations towards the seller, whatever be the cause.
The seller may need to ask for additional shipping costs for heavy or bulky products. For a precise quotation, the buyer must make a request in writing by contacting the customer service.
In the event the package and/or an item has been lost or damaged during transport, refer to Article 7 - Warranty and after sales service.
Under the conditions envisaged by the L121-16 article of the code of consumption and in the remote sale framework, the has a withdrawal period of 7 clear days as from the delivery of its order. The withdrawal period can be extended to 60 days according to the options selected by the buyer.
The item has to be returned in its complete and original packaging with instruction sheet and accessories.
In any case, the return of goods is under customers responsibility for the risks and for the costs. The products returned incomplete or damaged will neither be returned nor exchanged.
Return costs are the responsibility of the buyer. Carriage forward and payment at delivery shipments shall not be accepted.
Under the Order No. 2001-741 of 23 August 2001 Art. 5, Art. 12 Official Journal of 25 August 2001, Order No. 2005-648 of 6 June 2005 Art. 1 I Official Journal of 7 June 2005 effective 1 December 2005, unless otherwise agreed between the parties, the right of withdrawal cannot be exercised for contracts which supply goods made to the specifications of the consumer, or which are very personalized, or which, because of their nature, can not be returned, or are liable to deteriorate or expire quickly.
The paintings or custom puzzles sold on www.the-red-elf.co.uk are made upon order and are customized. As such, they can not be stocked. Thus, the right of withdrawal will not apply for paintings or custom puzzles, and no refund can be made.
Any return of goods requires prior agreement of the seller. The buyer must make a request in writing by contacting the customer service. The seller will send the buyer a return number to register absolutely on the package, as well as the address to which to return the product.
Upon receipt of the parcel, the customer service will refund you for your order.
Any sale concluded between a professional and Avenue des Jeux will give the right to a fixed compensation amount for collection costs.
Any late payment shall automatically result, on the day following the settlement date shown in the invoice, in the payability of a fixed compensation for collection costs in an amount of 40 euros (article L446-1 of the Business Code).
On reception, the buyer must immediately check the condition of goods and whether they match with the order.
Article 8 - 1 : Transportation problem
- In case the parcel is too damaged, the buyer must refuse it and contact our customer service.
- In case the parcel arrives with little or no damage, but the products inside were damaged during transport : the buyer must make a claim in writing within 48h with reception of the goods, without neglecting the recourse against the conveyor, in the absence of what the right to complaint will cease being acquired.
- In the case of a loss of parcel during transport or a delay in delivery, the buyer must contact the customer service which will contact the conveyor. The times of investigation can vary according to conveyors and take one up to three weeks.
Article 8 - 2 : After sales service
The products are guaranteed by the manufacturer (or importer), and by default by the SAS Avenue des Jeux, for defects in materials or fabrication for a period of 12 months from the date of delivery, except for conditions which are specifically notified. Interventions under guarantee do not have the effect of prolonging the duration of the guarantee. The seller's guarantee is limited to repair, replacement or refund value of the goods found defective by the seller, taking into account the use which has been done and this depending on the seller's free will.
The seller only agrees to provide the replacement of defective parts and repair the damages of the goods provided by their care. The guarantee does not cover the cost of labor, or those which result from disassembly, reassembly and transportation, except in the case of standard exchange.
Subject to the legal provisions, the responsibility for the seller is strictly limited to the obligations defined in the present conditions or, if necessary, the conditions expresses. If the buyer would turn over products which were not provided by the seller, the latter cannot, in any case, be held responsible for the material and immaterial damages which would intervene during the breakdown service.
The seller cannot be liable under the guarantee of failure or damage caused directly or indirectly in the following cases :
- Any negligence, error of connection or handling, use of the equipment not complying with the technical specifications of the seller or the manufacturer or, more generally, defective or clumsy use.
- Any addition of complementary device or accessory of the equipment or use of all parts necessary for the exploitation of the equipment not in conformity to the technical specifications of the seller or manufacturer.
- Any modification or mechanical, electrical, electric or other transformation brought to the equipment or connection apparatus by a third party.
The buyer must inform the customer service of their claim in writing At this occasion, the buyer must give their precise coordinates and supply the designation and/or the reference of the elements concerned, as well as an identification of the problem (breakdown, missing part..) and the corresponding invoice number.
In the context of the return of a defective product under warranty, the seller will pay the return costs for the product.
The buyer has 7 days to return the defective products after obtaining the seller's approval.
In case of a return, the letters "SAV" followed by the return number given by the seller should appear directly on the parcel, and a copy of the invoice should be enclosed in it. Failing an agreement, any goods returned will be held available for the buyer at their expense, risks, and perils, any transport, storage, and handling of goods being at the expense of the buyer.
In the case of bankruptcy or impossibility of supply of the manufacturer, the buyer cannot make any claims against the seller.
Article 8 - 3 : Incorrect reference, photo or description on the website, incomplete order
All the complaints relating to a defect of the delivered goods, an inaccuracy in the quantities or their erroneous reference compared to the accepted offer or to the confirmation of order by the seller, must be formulated in writing within 48h with reception of the goods, without neglecting the recourse against the conveyor, in the absence of what the right to complaint will cease being acquired. The buyer must allow the seller to carry out all the operations of checking on site relating to the complaints.
The buyer must inform the customer service of their claim in writing At this occasion, the buyer must give their precise coordinates and supply the designation and/or the reference of the elements concerned, as well as an identification of the problem (missing part., erroneous photo, reference error...) and the corresponding invoice number.
Customers who subscribed to the "Serenity Pack" when they ordered will dispose of :
Extension of the warranty period to 2 (two) years. The manufacturer's warranty is valid for 1 year on some items. Our Serenity Pack allows you to benefit from an extension of the warranty period to 2 years. This warranty covers your item upon receipt against any breakdown that would occur during a normal use. In the event of the return of a defective item under warranty, we will bear the costs of the repairs or exchange as well as the return fees.
Extension of the withdrawal period to 60 (sixty) days. Valid accounting from the date of delivery of your order. This delay does not apply to :
- Products manufactured according to the client's specifications such as personalized jigsaw puzzles.
- Products that, because of their nature, can not be returned, or are liable to deteriorate or expire quickly (paints, glues and varnishes, foodstuffs).
Satisfied or refunded during 60 days : You have the right to make mistakes and to change your mind. We engage to issue refunds for products that have not been unwrapped and returned intact during a 60-day period from the date of delivery.
Transport insurance : all the carriers entrusted with the transportation of your orders have an insurance in case of loss, theft or deterioration of your parcel.
Dead-on-arrival or incomplete product : immediate exchange valid for 7 days from the delivery date of the product for products acknowledged as defective, subject to availability of the requested product in stock, not including the delay for the receipt and shipping of the missing or defective parts.
Customers who subscribed to the "Serenity Pack" when they ordered will dispose of the right to use the "Satisfied or refunded" service for 60 days from the delivery date of their order. If you are not satisfied with the product your received, you have 60 days, from the date of delivery, to return us the products in their original perfect conditions. Our company is responsible for refunding the amounts paid, including the shipping fees, in the case of returned products. However, return fees are at your charge.
Any return made in the 60-day period results in the refund of the total amounts paid in the best delay possible, and at the latest in the 30 days following the date from which this right was exercised.
In this case, return of the products requires prior authorization by the seller. To obtain a return number, the customer must contact the Customer Service. Upon receipt of the parcel, we will issue a refund for your order.
The prices appearing on the website www.the-red-elf.co.uk are all taxes included. Residents of the European Union cannot benefit from the French VAT exemption. If your are a non-French VAT-registered company of the European Union, you must make a written request with the precise denomination of your company and the intra-Community number. In that case, we will send you an invoice exclusive of tax, made out in the name of your company, together with the VAT refund.
If you are a resident outside of the European Union and French overseas departments and territories, the VAT exemption is granted by right and automatic. You do not need to do anything. Entering your delivery address while confirming your order will result in the VAT exemption.
This exemption will clearly appear on the last step of your order confirmation. Your invoice will thus be made exclusive of tax and the requested payment will correspond to the amount of your order exclusive of tax. Orders placed outside the European Union (Switzerland, rest of Europe outside the EU, French overseas departments and territories, rest of the world) may incur custom duties.
These orders may also be subjected to the concerned country's local VAT. For information on this matter, you can ask the customs services of the concerned country. The Avenue des Jeux company cannot be held responsible for these custom duties and VAT fees.
Under the Act of May 12th, 1980, the transfer of ownership of goods delivered to the client only occurs after full payment of the principle and additional price or the banking of accepted bills of exchange or other payment means issued to settle the price. During the period between delivery and transfer of ownership, however, risks of loss, theft or damage are borne by the buyer.
The failure by the buyer of their payment obligations gives the seller the right to demand the immediate return of goods delivered to the expense and risk of buyer. The buyer engages, in the case of a legal procedure of rectification affecting their company, to take an active part in the establishment of an inventory of the goods being in their stocks and of which the seller asserts the property.
Otherwise, the seller has the right to see the inventory by a bailiff, at the expense of the buyer. The seller can prohibit the buyer from reselling, processing or incorporating of goods, in case of late payment. To guarantee the payments not yet carried out and in particular the balance of the account of the buyer in the writings of the seller, it is expressly stipulated that the rights relating to the delivered but unpaid goods will defer on the goods identical coming from the seller in stock at the buyer, without it being necessary to charge the payments to a sale or given delivery.
In case of non-observance of one of the buyer's obligations, the sale will be canceled by full right and the goods will be restored to the seller if they see fit, without prejudice to any damages that might be applicable by the seller to the buyer, under a 48 hours deadline. In this case, the seller is authorized to charge the buyer a fixed allowance of 15% of the amount of the sale.Back to top
In order to better secure the use of means of payment Avenue des Jeux reserves the right to ask for documentary evidence (concerning identity and/or domicile). We inform our clients that the failure or refusal of transmitting the required documents could lead us to not honoring the concerned orders. Furthermore, the transmission delay of the required documents can delay the shipping or delivery of the ordered products all the more.
Payments should be made in such a way that the seller can dispose of the amounts on the due date. Except expressly written conditions or specific conditions granted to the company clients after study of their file, the payments must be carried out by transfer on order (bankcard).
The service is available for any purchase without a minimum amount. The order confirmation via Paypal means mandate to pay the amount of the order all taxes included. By choosing Paypal as a method of payment, you are authorizing Avenue des Jeux to debit your account at any time for the payment of your order.
We accept payment by bank transfer. The order processing begins upon receipt of the bank transfer. If we do not receive it within 10 days the order will be canceled.
Any payment made after the fixed due date may result in the invoicing of penalties without the need for prior formal notification of the buyer.
The amount of these penalties would be at least equivalent to a rate of 1,5 times the legal rate of interest to the day of the application of the penalties, without this clause excluding complementary damages.
The buyer can never, for a claim formulated by themself, retain the totality or a part of the amount that they must pay, nor resort to a compensation. When the buyer is late for the payment, the seller can, by this only fact and without the necessity of a prior notification, immediately suspend the deliveries, without the buyer being able to ask the seller for damages.
In the event of legal proceedings, the seller has the right to ask the buyer for the refund of all costs concerning such proceedings. For payments made on the website, the seller reserves the right to ask the buyer to justify their identity and place of residence.
Pursuant to Article 34 of the Act on "Data Processing, Data Files and Individual Liberties", the SAS Avenue des Jeux guarantees the User the right to access, correct or eliminate his nominative data. The User can exert this right :
